    2019, 45 (6):  27-32.  doi: 10.15942/j.jcsu.2019.06.007
    Abstract ( 846 )   PDF (1201KB) ( 574 )   Save
Examination of legal judgments reveals that the Sports Law has been applied to judicial practice since it was promulgated in 1995. Legal judgments based on the Sports Law involve civil, administrative and criminal cases, among which the former two types are in the majority. The judicial application of the Sports Law is unbalanced in time, court level and region. There are two types of quotation mode: the fuzzy application and the direct application. In terms of function, the Sports Law plays the roles of claim, value declaration, procedural jurisdiction and substantive norms in court judgment. On the whole, the quotations of the Sports Law in judicial judgments have not only the general characteristic of court judgments, but also the unique characteristic of the Sports Law. The judicial application is not only an important index to test the legislative effect of the Sports Law, but also provides a window to observe and prefect the Sports Law.

The current popularity of sports tourism suggests the necessity to put sports tourism under the rule of law. The development of sports tourism resources involves a wide range of resources, many subjects and great responsibilities. It requires that the sustainable development of sports tourism must first regulate its rationality and legitimacy from the perspective of resources development. Based on the principle of intergenerational equity in the development of sports tourism resources, the development of sports tourism resources are divided by means of logical reasoning, case analysis, interest measurement and substantive reasoning into three stages: sports tourism project planning, sports tourism project construction and sports tourism operation and management. The research holds that: the three stage can serve as the starting point to solve the problem of intra-generational and inter-generational equity in the development of sports tourism resources at each stage, and demonstrate and identify the rationality and legitimacy of the development of sports tourism resources from the perspectives of moral proposition and legal responsibility. It is hoped that this study can provide academic support for the rise and future development of sports tourism from the perspective of intergenerational equity in resource development.

The formulation and implementation of the national strategy of “Healthy China” has promoted the organic combination of sports and hygiene, and aroused a thought-provoking on the relationship between the traditional martial arts and traditional medicine, which made the long-silenced theory and practice study of relationship between the two aspects of the traditional ethnic sports has rapidly become a hot spot. From the perspective of historical materialism and dialectical materialism, the evolution of the relationship between “martial arts” and “traditional medicine” can be divided into three stages: integration, differentiation and combination. The logic of the germinal development in the integration stage can be summarized as follows: the closure of farming culture; the order of rural society; the integration of practical rationality. Three factors are attributed to the changes of differentiation stage: the impact of Material reductionism on the holistic view; the impact of individual standard on family standard; the impact of scientific rationality on practical rationality. The idea of reconstruction of the combination stage can be summed up as follows: the reconstruction of the technical system under the concept of “Extensive Hygiene”; the reconstruction of the inheritance way under the concept of “Extensive Sports”; and the reconstruction of the thinking mode under the concept of “Extensive Health”.
