Abstract:
Sport broadcasting rights is an important element of professional sport development. This present paper compared the name, content, legal attribute, ownership and legal protection, and regulation of market in US, UK, Germany, France, Italy, Span, and Portugal, and analyzed their legal and systematic response under the rapid development of information technology and communication market. Combined with the situation of professional sports broadcasting right in China, this present paper pointed out that: as a legal right, the professional sports broadcasting right has become a trend of development, and it is better to protect the right as a compound of a new type of property right and adjacent right; club is the natural owner of professional sports broadcasting right, and the league or association is the co-owner; the combination of collective sales and individual sales is a better marketing mode for professional sports broadcasting right; and the balance between public welfare and market is a factor to be considered in system design.
